I am no expert regarding the constitution but overriding the American voters and ignoring state law seems to be either unconstitutional or at least illegal. Using one amendment to override another amendment tells us that at any point they can ignore the constitution. Using the 14th to override the 10th means what? That the 10th doesn’t really mean anything?
Tenth Amendment:
The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
Why should anyone vote if those votes don’t ultimately count?
Regarding the decision to make gay marriage legal in all 50 states, I’ve never really cared whether it was legal or not… it hasn’t been one of my major beliefs one way or the other. What I do care about is the Supreme Court making a decision to overrule votes of American citizens and taking power away from the states. This could sadly be the first of many… from now on when certain people or groups don’t get what they want, they will throw a temper tantrum and shout “Lets send it to the Supreme Court… they will give us what we want”.I realize changes need to happen. I also think that those changes were coming anyway and that if the states persisted with voting, gay marriage would have been passed in more and more states and eventually nation wide. Now all they’ve done is force an issue into existence rather than letting it happen through voter choice.
Here are my previous posts on gay marriage. I have only voted once on the subject and that was after the riots in California. Not getting your way is no reason to destroy other people’s property and lives. The voting process is there for a reason and sometimes it takes a while to get what you want. And sometimes you never get everything you want. But there are those who truly feel that they deserve everything to be their way and their way only. I didn’t care one way or the other until those riots. Since then, now years later, I’ve gone back to not voting on the subject because I don’t feel anyone should vote on something that they either a) don’t have enough information on or b) don’t have enough reason to vote yes or no. If my state decided to make it legal and I did not vote then I would not complain. On the other hand, if my state decided to make it illegal I could again not complain if I did not vote.
But now… now it doesn’t matter if I vote or not because the Supreme Court can say “so what… we want it this way and that’s just they way you’re going to get it… like it or not”.
